State Laws on Pesticide Application Notifications

notice of pesticides

I’d like notifications about when and where pesticides and herbicides have been sprayed in my area. Is there a place where I can look for pesticide warnings or pesticide application signs?

Over the past decade, public concern about the potential hazards associated with chemical lawn care products and services has steadily increased. According to the U.S. Environmental Protection Agency (EPA), 176 million pounds of pesticides are applied on non-agricultural lands per year. Of that, at least 70 million pounds of pesticides are applied to lawns, including residential lawns, golf courses, and parks. As a result, there is widespread public exposure to pesticides in towns, cities, suburbs, and rural areas.

Notification. Pesticide application notifications allow people to take precautions to avoid direct exposure to hazardous pesticides. Twenty-three states, plus Washington D.C., have adopted laws requiring hired applicators to warn people about lawn, turf, and ornamental pesticide applications by giving prior notification to the owners of abutting properties, posting pesticide application signs, or establishing registries. Because not all U.S. households hire a lawn professional, some states also require homeowners to notify neighboring properties.

State notification laws usually require the listing of which pesticide has been applied, the location of application, and the applicant. Prior notification, if required, generally must be given 24 to 48 hours in advance.

Posting. In the states that require commercial applicators to post notification signs when they apply a pesticide to a lawn, they usually must put the pesticide application sign in a conspicuous point of access to the treated property and leave it in place for 24 hours. Warning signs vary in language but typically state something like, “Lawn Care Application: Keep off the Grass.”

NO SCIENTIFIC JUSTIFICATION FOR SIGN-POSTING IN THE 9|11 ERA OF PESTICIDE-HATING ENVIRONMENTAL-TERRORISM ! For over 30 years, our society has faced a hostile pesticide-hating ideology that is global in scope, fanatical in character, ruthless in purpose, and lunatic in method, with issues such as SIGN-POSTING, which was the FIRST STEP TOWARDS PROHIBITION against ALL pest control products. SIGN-POSTING was adopted by the Professional Lawn Care Industry almost 30 years ago, NOT as a health and safety issue, but as an APPEASEMENT issue. In 1987 and 1988, the Professional Lawn Care Industry in both the Provinces of Quebec and Ontario VOLUNTARILY ADOPTED SIGN-POSTING POLICIES. Quebec eventually became the FIRST PROVINCIAL ( STATE ) JURISDICTION to IMPOSE PROHIBITION against pest control products used in the Urban Landscape, in the period 2003 to 2006. For years, Anti-Pesticide Activists had DEMANDED, through COERCION, INTIMIDATION, and TERRORISM, that SIGN-POSTING with NO scientific justification ! Moreover, Anti-Pesticide Activists had also DEMANDED signs which prominently displayed the IMAGE OF A SKULL, again, with NO scientific justification ! As an alternative to the IMAGE OF A SKULL, a sign with the internationally recognizable symbol of DO NOT WALK was proposed by Mr William H Gathercole, which was finally accepted by Government Officials and the Professional Lawn Care Industry in 1987. Unfortunately, SIGN-POSTING was READILY AGREED TO by the Professional Lawn Care Industry in the MISTAKEN BELIEF that it would somehow APPEASE the Anti-Pesticide Fanatics. As we all know, Anti-Pesticide Fanatics were / are NEVER EVER APPEASED. In the 9|11 Era of Pesticide-Hating Environmental-Terrorism … RECKLESS AND ARBITRARY PROHIBITION commenced against the urban use of pest control product over 30 years ago. This form of TERRORISM will NEVER END, and have now spread against FERTILIZERS. Anti-Pesticide Fanatics are also eliminating pest control products from the HATED GOLF INDUSTRY. And also ... NURSERY PRODUCTION. And also ... AGRICULTURE. And finally ... RECKLESS AND ARBITRARY PROHIBITION has spread NATIONALLY, and even INTERNATIONALLY, against ALL pest control products. ANTI-PESTICIDE & ENVIRONMENTAL-TERRORISM WILL NEVER END ! And, it all began with the practice of SIGN-POSTING. SIGN-POSTING was NEEDLESS, and was originally considered as a courtesy to the Professional Lawn Care customer and neighbors, and an opportunity for some LIMITED advertising. Sadly, SIGN-POSTING was the FIRST STEP TOWARDS PROHIBITION against ALL pest control products.
